State Judicial Inquiry Commission seeks 'expedited response' to its questions for Judge Stuart DuBose
Asks for answers in 7 days

The Alabama Judicial Inquiry Commission and its attorney, Thomas Sorrells of Dothan, have served Circuit Judge Stuart DuBose with a set of interrogatories regarding his claim of diminished capacity and asked the Court of the Judiciary to require an "expedited response," within seven days of the March 25 filing.

Interrogatories are a set of written questions that are a part of a pre-trial discovery process. They must be answered in writing and under oath.

Judge DuBose, on March 12 in answer to a complaint filed against him by the Judicial Inquiry Commission alleging 60 counts of violations of the judicial canons of ethics, said that he was "suffering under diminished capacity."

Sorrells said the Judicial Inquiry Commission is entitled to know the identity and location of any witnesses who have evaluated or treated Judge DuBose in relation to his claim of defense.

The commission said it needed the information "to meet said defenses at trial, even though the JIC (Judicial Inquiry Commission) maintains the Respondent's (DuBose's) claim is no defense to the charges against him."

The motion said only "basic information and names" are being sought and it would not be a hardship for DuBose to respond within seven days.

Judge DuBose has been suspended from the bench since the Jan. 31 complaint was filed.

The Court of the Judiciary is a special appointed court that hears complaints against judges. If the matter goes to trial, the court could permanently remove DuBose from the bench or otherwise reprimand him.

The Judicial Inquiry Commission is the investigative and prosecutorial division.
