Schmitz trial begins

The trial of a Leroy High School teacher accused of enticing a child by computer and enticing a child by cell phone was set to begin in Federal Court in Mobile this week.

Charlene Schmitz, 55, who was arrested in June 2007, is accused of soliciting sex from a 14-year-old student. She was arrested a second time Nov. 23 during a Leroy High School football game for allegedly having illegal contact with the student. She was charged with tampering with a witness.

According to an article in Monday's Mobile Press- Register, prosecutors had asked U.S. District Judge Kristi DuBose to delay the trial on grounds that they needed more time to review hundreds of pages of medical records provided by defense attorneys past a court-set deadline. The documents would supposedly prove that Schmitz suffers from a condition that prevents or inhibits her from having sex.

The federal trial will focus on whether or not Schmitz used a computer to lure the student for sex. Prosecutors are not required to prove that an actual sex act occurred.

According to the article, Judge DuBose denied the prosecution's motion, stating that she could not imagine how the records would be admissible. She added that by the time the trial would begin (Feb. 13), prosecutors would have had the records for two weeks.

Schmitz was taken into custody by FBI agents, Nov. 27, 2007, following a bond revocation hearing in Washington County Court. She first appeared in a Mobile federal court Nov. 30, at which time she was denied bail by U.S. Magistrate Judge Bert Milling.
