NOTICE OF FINDING OF
NO SIGNIFICANT IMPACT ON
THE ENVIRONMENT

TO ALL INTERESTED AGENCIES,
GROUPS AND PERSONS:
The above named unit of government
proposes to request the
Alabama Department of Economic
and Community Affairs to release
Federal Funds under Title I of the
Housing and Community
Development Act of 1974 (PL 93383)
to be used for the following project:
The City of Jackson plans to provide
site preparations for the construction
of a new wood-pellet plant (Dixie
Pellets) located on a 57 acre lot owned
by the City just off of Alabama HWY
177 (one mile east of U.S. HWY 43).
The proposed project includes the
preliminary site work and grading for
the new plant that includes clearing
and grubbing, 203,700 cubic yards of
unclassified excavation and 162,890
cubic yards in place of embankment ,
along with 7 acres of hydro-seeding
and mulching, 10,800 linear feet of silt
fence, type A, and 300 hay bales. The
City has a 10" water main located
adjacent to the site, and a sewer pump
station within 1,000 feet of the site
which will be made available to the
plant once constructed.
Estimated Cost: $1,000,000
It has been determined that such
request for release of funds will not
constitute an action significantly
affecting the quality of the human
environment and accordingly the
above-named unit of government has
decided not to prepare an
Environmental Impact Statement
under the National Environmental
Policy Act of 1969 (PL 91-190).The
reasons for such decision not to prepare
such statement are as follows:
The project will have no lasting
adverse impact. Some temporary
adverse conditions will result from the
construction of the project. These
conditions include dust and noise.
Standard construction practices, good
housekeeping, and Best Management
Practices should be sufficient to prevent
permanent adverse impacts on
the environment.
The project will not alter land use
patterns in the county or surrounding
area. The beneficial impact far
outweighs any consideration of the
alternative which is not to implement
the project.
An Environmental Review Record
respecting the within project has been
made by the above-named municipality
which documents the environmental
review of the project and more
fully sets forth the reasons why such
Statement is not required. This
Environmental Review Record is on
file at the above address and is available
for public examination and
copying upon request at City Hall, 400
Commerce Street, Jackson, Alabama
36545 between the hours of 9:00 a.m.
and 4:00 p.m. Monday through
Friday.
No further environmental review of
such project is proposed to be conducted
prior to the request for release
of Federal Funds.
All interested agencies, groups and
persons disagreeing with this decision
are invited to submit written comments
for consideration by the City
Council. Written comments may be
mailed to the City Clerk, City of
Jackson, Post Office Box 1096,
Jackson, Alabama 36545 or hand
delivered to: Ms. Betty Powell, City
Hall, 400 Commerce Street, Jackson,
Alabama 36545 on or before 4:00
p.m. on February 1, 2008. All such
comments so received will be considered
and the city will not request
release of Federal Funds or take any
administrative action on the within
project prior to the date specified in
the preceding sentence.

ADVERTISEMENT FOR BIDS
Sealed bids, subject to the conditions
contained herein, will be
received by the City of Jackson until
2:00 p.m., Local Time, Thursday
January 31, 2008, and then publicly
opened and read at their office located
at 400 Commerce Street, Jackson,
AL, for furnishing all labor and
materials and performing all work
for construction of: MASS GRADING
PLAN FOR INDUSTRIAL
ACCESS ROAD AND SITE.
The project consists of mobilization
of earthworking equipment;
clearing and grubbing; 204,000 cubic
yards of unclassified excavation;
163,000 cubic yards in place of
embankment, 7 acres of hydro-seeding
and mulching; and any necessary
erosion control measures.
The CONTRACT DOCUMENTS
AND PLANS may be examined at
City Hall in Jackson, Alabama, at the
office of Goodwyn, Mills and
Cawood, Inc. in Montgomery,
Alabama and at McGraw-Hill Plan
Room in Montgomery, AL.
Copies of the CONTRACT DOCUMENTS
AND PLANS may be
obtained at the office of Goodwyn,
Mills and Cawood, Inc. upon payment
of $100.00 for each set which
includes printing, reproduction, shipping
and handling by U.S. Mail, etc.
Deposit shall be refunded in full to
each prime contractor bidder submitting
a bonafide bid within 20 days
after bid opening, provided the bid
documents are returned in clean,
reusable condition within ten (10)
days after bid opening. No partial
sets, individual pages or drawing
sheets will be provided.
All bidders must comply with the
President's Executive Order Number
11246 which prohibits discrimination
in employment regarding race, creed,
color, sex or national origin. All bidders
must comply with title VI of the
Civil Rights Act of 1964, the Davis-
Bacon Act, the Anti-Kickback Act
and the Contract Workhours Act.
The attention of bidders is particularly
called to the requirements as to
conditions of employment to be
observed and minimum wage rates to
be paid under the Contract.
The Owner reserves the right to
waive any informalities, or to reject
any or all bids, and to award the contract
to the lowest and most responsible
bidder. All bidders must comply
with requirements of the
Contractor's Licensing Law of the
State of Alabama and be certified for
the type of work on which the proposal
is submitted. Each bidder must
deposit with his bid, security in the
amount, form and subject to the conditions
provided in the Information
for Bidders.
All Contractors preparing Bids for
the referenced project shall submit a
list of similar projects, successfully
completed, in the last 2 years, having
the same scope of work with construction
cost similar to or greater
than this project. All nonresident
contractors preparing bids shall submit
with the bid documents evidence
of a current Alabama General
Contractor's License, evidence (with
original seal of the State of Alabama)
of proper registration with the
Alabama Secretary of State as a foreign
corporation, and a Certificate of
Good Standing as a Foreign
Corporation from the State of
Alabama Department of Revenue.
Bids submitted by a nonresident contractor
without these documents
included will be rejected.
No bidder may withdraw his bid
within 60 days after the opening
thereof. Bids may be held by the
Owner for a period not to exceed
sixty (60) days from the date of opening
of bids for the purpose of reviewing
the bids and investigating the
qualifications of the bidders prior to
awarding the contract. This project is
being funded in part by CDBG
Project No. LR-ED-PF-07-011.
All bids should be submitted in the
Contract Specifications Book as
issued by the Engineer. All bids must
be submitted in a sealed envelope
bearing on the outside the name of
the Bidder, Bidder's license number,
address and name of the project.
Envelopes containing bids must be

FUNDS

On or about February 2, 2008 the
above-named municipality will
request the Alabama Department of
Economic and Community Affairs to
release Federal Funds under Title I
of the Housing and Community
Development Act of 1974, (PL 93-383)
for the following project:
The City of Jackson plans to provide

An Environmental Review Record
respecting the within project has
been made by the above-named
group which documents the environmental
review of the project.
This Environmental Review Record
is on file at the above address and is
available for public examination and
copying upon request. The City of
Jackson will undertake the project
described above with Block Grant
Funds from the Alabama
Department of Economic and
Community Affairs, under Title I of
the Housing and Community
Development Act of 1974. The City is
certifying to the State that the City
Council and Richard Long in his
official capacity as Mayor consent to
accept the jurisdiction of the
Federal courts if an action is
brought to enforce responsibilities
in relation to environmental review
decision making and action; that
these responsibilities have been satisfied.
The legal effects of the certification
is that upon its approval, the
City of Jackson may use Block Grant
funds and the State will have satisfied
its responsibilities under the National
Environmental Policy Act of 1969.
The State will accept an objection to
its approval of the release of funds
and acceptance of the certification
only if it is on one of the following
bases: (a) That the certification was
not in fact executed by the Chief
executive officer or other officer of
applicant approved by the State; or
(b) that the applicant's
Environmental Review Record for
the project indicates omission of a
required decision, finding or step
applicable or the project in the
environmental review process.
Objections must be prepared and
submitted in accordance with the
required procedure (24 CFR Part 58)
and may be addressed to the State at:
Alabama Department of Economic
and Community Affairs, 401 Adams
Avenue, Post Office Box 5690,
Montgomery, AL 36103. Objections
to the release of funds on bases other
than those stated above will not be
considered by the State. No objections
received after February 17,
2008 will be considered by the State.

ITEM I
ADVERTISEMENT FOR BIDS
Sealed bids, subject to the conditions
contained herein will be received by
the Washington County Commission
until 9:30 a.m., Local Time, Monday,
January 28, 2008, and then publicly
opened and read in the
Commissioners Meeting, which
begins at 10:00 a.m. at the
Washington County Commission,
Commissioner's Court Room, located
at 45 Court Street, Chatom, Alabama
36518 for furnishing all labor and
materials and performing all work for
the Washington County project "New
Booster Station - Foundation,
Fencing, Electrical Service, and
Piping." The work consists principally
of the following:
Construction of the Concrete
Foundation, Fencing, Electrical
Service, and Piping for a New Booster
Station to be built on Beaver Dam
Road
Thirty (30) working days are allowed
for the construction of the project.
All bids must be on blank forms provided
in the Contract Specifications
Book and submitted in its entirety. A
cashier's check drawn on an Alabama
bank or a Bidder's Bond, payable to
Washington County, Alabama, for an
amount not less than five percent
(5%) of the amount bid, but in no
event more than ten thousand dollars,
shall be filed with the proposal. The
bidder's bond shall be prepared on
the form specified and signed by a
bonding company authorized to do
business in the State of Alabama.
A performance bond in the form and
terms approved by the County in an
amount not less than the contract
price will be required at the signing of
the contract. A labor and materials
bond in the form and terms approved
by the County in an amount not less
than fifty percent (50%) of the contract
price insuring payment for all
labor and materials shall also be
required at the signing of the contract.
In addition, the Contractor
must furnish to the County at the time
of the signing of the contract a certificate
of insurance coverage as provided
in the specifications. The right is
reserved to reject any and/or all bids
and to waive informalities and to furnish
any item of material or work to
change the amount of said Contract.
Liquidated damages for non completion
of the work within the time limit
agreed upon will be assessed in accordance
with the terms of the contract.
Specifications are on file and may be
seen in the Office of the Washington
County Commission, and in the office
of SPEAKS & ASSOCIATES CONSULTING
ENGINEERS, 732 Oak
Circle Drive West, Mobile, Alabama.
Specifications may be obtained by
depositing SEVENTY-FIVE ($75)
dollars with the Project Engineer for
each set. This deposit shall be
refunded in full to each prime
Contractor Bidder upon return of the
documents in reusable condition within
ten (10) days after Bid Opening.
The cost of and return of additional
sets of Specifications shall be in
accord with Act 97-225, Public Works
Contracts. No specifications will be
issued to contractors later than twenty
four (24) hours prior to the time
indicated above for receiving bids.
No bids will be considered unless the
bidder, whether resident or non resident
of Alabama, is properly qualified
to submit a proposal for this construction
in accordance with all applicable
laws of the State of Alabama. This
shall include evidence of holding a
current license from the State
Licensing Board for General
Contractors, Montgomery, Alabama,
as required by Chapter 8 of Title 34,
of the Code of Alabama, 1975.
In addition, non residents of the State,
if a corporation, shall show evidence
of having qualified with the Secretary
of State to do business in the State of
Alabama.
No bid shall be withdrawn for a period
of thirty (30) days subsequent to
the opening of bids without the consent
of the Washington County
Commission. A tabulation of the low
bid received will be sent to all bidders
within one (1) week of the bid opening.

All bids shall be submitted in the complete
Contract Specifications Book as
issued by the Project Engineer. Bids
not submitted in the Contract
Specifications Book will not be
opened. All bids must be submitted in
a sealed envelope bearing on the outside
of the envelope the name of the
Bidder, Bidder's license number,
county's address, and the name of the
project clearly written: "New Booster
Station - Concrete Foundation,
Fencing, Electrical Service, and
Piping". Bids may be hand delivered
to: Janelle Sanderson, County
Administrator, Washington County
Commission, P.O. Box 146, Chatom,
Alabama 36518.
